On Monday, reports revealed that a grand jury witness admitted the Lincoln Memorial Reflecting Pool was damaged before the prosecution of David Hearn, a former Olympic canoeist who was arrested and charged with felony damage to property after he touched some of the peeling paint in the pool. The admission undercuts the Trump administration’s claims that Hearn was responsible for damaging the pool.

Hearn’s lawyers slammed the indictment in a letter on Tuesday, arguing that the Trump DOJ prosecutors acted improperly. Those claims caught the ear of former federal prosecutor Glenn Kirschner. He argued in a new podcast that the case seemed destined to go the same way as the prosecutions against former FBI Director James Comey, New York Attorney General Letitia James, and the Broadview Six, all of which were dismissed by judges for prosecutorial misconduct.
