Justice Samuel Alito<\/u> wrote the conservative majority\u2019s opinions in two of the most consequential Supreme Court<\/u> decisions in recent years: 1) \u2014<\/em><\/em>overruling Roe v. Wade<\/em><\/u><\/em>; <\/em><\/em>and 2) \u2014<\/em><\/em>neutering the Voting Rights<\/u> Act of 1965. In both cases, Alito recited and relied on asserted \u201cfacts\u201d that did not exist.<\/p>\n

Alito Rewrote History to Ban Abortion<\/h4>\n

Ohio State University Prof. Treva Lindsey observed<\/u>, \u201cFrom the nation\u2019s founding through the early 1800s, pre-quickening abortions<\/u>\u2014that is, abortions before a pregnant person feels fetal movement\u2014were fairly common and even advertised.\u201d<\/p>\n

But Alito claimed incorrectly in that \u201cno common-law case or authority… remotely suggests a positive right to procure an abortion<\/u> at any stage of pregnancy\u201d and, in the United States<\/u> specifically, \u201can unbroken tradition of prohibiting abortion on pain of criminal punishment persisted from the earliest days of the common law until 1973.\u201d<\/p>\n

Writing for the three dissenters, Justice Elena Kagan called Alito \u201cembarrassingly\u201d wrong. There was no such<\/u> \u201cunbroken tradition,\u201d and historical evidence undermined his claim. But the conservative majority got its desired outcome.<\/p>\n

Roberts Began the Assault on the Voting Rights Act<\/h4>\n

In 2013, Chief Justice John Roberts and the conservative majority began undermining the Voting Rights Act in the Shelby County<\/em><\/u><\/em>case. Prior to that decision, <\/em><\/em>states and localities with a history of racial discrimination in voting had to obtain federal approval before<\/em><\/em> making changes to election rules\u2014a process known as preclearance. The state or locality had to prove that any changes would not disadvantage racial and ethnic minorities.<\/p>\n

Rewrite history; distort reality; make up facts; overturn longstanding precedent. For Justice Alito\u2014with an occasional assist from Chief Justice Roberts\u2014it\u2019s all in a day\u2019s work.<\/em><\/em><\/p>\n

Roberts argued that the elections of 2008 and 2012\u2014when there was no difference in voter participation rates between Black and white voters (i.e.,<\/em><\/em> no \u201cturnout gap\u201d)\u2014meant that the Voting Rights Act had done its job and preclearance could be suspended.<\/p>\n

Even at the time, Roberts\u2019 reasoning was suspect. The elections of 2008 and 2012 were anomalies<\/u>\u2014not the end of the turnout gap\u2014because Barack Obama\u2019s candidacy had driven up Black turnout.<\/p>\n

In her dissent<\/u>, Justice Ruth Bader Ginsburg<\/u> noted another flaw in Roberts\u2019 logic: \u201cThrowing out preclearance when it has worked and is continuing to work to stop discriminatory changes is like throwing away your umbrella in a rainstorm because you are not getting wet.\u201d<\/p>\n

Justice Ginsburg was correct, and now democracy<\/u> is getting wet. A 2024 study concluded<\/u>:<\/p>\n

The formerly covered states [subject to preclearance] have large nonwhite populations and large turnout gaps, leading to some of the largest statewide turnout distortions in the nation. Put differently, a decade after Shelby County<\/em><\/em>, the turnout gap continues to have a disproportionate impact in precisely the parts of the country that were once covered due to their histories of racially discriminatory voting practices.<\/p>\n

Stated<\/u> simply, \u201c[S]ince 2013, the racial turnout gap around the nation has exploded.\u201d<\/p>\n

Alito Finished the Job<\/h4>\n

Justice Alito ignored the exploding turnout gap in striking the fatal blow to the Voting Rights Act on April 29, 2026.<\/em><\/em> For decades previously, the court repeatedly that a state could not undermine minority voters\u2019 power to choose their desired candidates by drawing legislative districts that dispersed such voters across majority-white districts. Instead, states had to create \u201cmajority-minority\u201d districts, thereby assuring minority representation in statehouses and Congress.<\/p>\n

In its amicus<\/em><\/em> brief<\/u> to the court in the Callais <\/em><\/em>case, the Department of Justice<\/u> (DOJ) ignored the trend after 2013 and argued that majority-minority districts were no longer necessary because \u201cthe racial gap in voter registration and turnout had largely disappeared, with minorities registering and voting at levels that sometimes surpassed the majority. Shelby County<\/em><\/em>, 570 U.S. at 547-548.\u201d To emphasize the point, the DOJ observed, \u201cSince 2004, black voters have turned out at higher rates than white voters in two of five presidential elections nationwide and in Louisiana.\u201d<\/p>\n

Armed with the Callais decision, <\/em><\/em>Republicans<\/em><\/u><\/em> are now racing to eliminate majority-Black districts throughout the country.<\/em><\/em><\/p>\n

Alito the DOJ\u2019s sophistry: \u201cBlack voters now participate in elections at similar rates as the rest of the electorate, even turning out at higher rates than white voters in two of the five most recent Presidential elections nationwide and in Louisiana.\u201d<\/p>\n

As election experts have observed<\/u>, Alito\u2019s claim that Black and white turnout reached parity in 2 of the 5 most recent presidential elections \u201crepresents egregious cherry-picking. [H]e was not referring to recent<\/em><\/em> elections, but to those in 2008 and 2012\u2014the years that Barack Obama<\/u> ran for president. In the three most recent presidential elections, the trend shows exactly the opposite. The indisputable fact is the racial turnout gap is widening, and the Roberts Court is partially responsible [because of its Shelby County <\/em><\/em>decision].\u201d<\/p>\n

Armed with the Callais <\/em><\/em>decision, Republicans are now racing to eliminate majority-Black districts throughout the country.<\/p>\n
