Pischke was unopposed in the primary and faces an independent candidate named Bryan Breitling, who\u2019d previously served in the state legislature as a Republican, in the general election.<\/p>\n<p>Pischke turned himself in on Tuesday morning. He was arrested, booked into the Minnehaha County Jail, and released on his own recognizance before the Minnehaha County Sheriff\u2019s Office sent a news release announcing that the charges had been filed.<\/p>\n<blockquote><p>South Dakota lawmaker charged with felony for allegedly damaging public road on purpose<\/p><\/blockquote>\n<p><iframe loading=\"lazy\" frameborder=\"0\" height=\"282\" src=\"https:\/\/southdakotasearchlight.com\/2026\/06\/11\/south-dakota-lawmaker-charged-with-felony-for-allegedly-damaging-public-road-on-purpose\/embed\/#?secret=Ebb1aU1Ynn#?secret=iQRyDTNP7F\" title=\"\u201cSouth Dakota lawmaker charged with felony for allegedly damaging public road on purpose\u201d \u2014 South Dakota Searchlight\" width=\"500\"><\/iframe><\/p>\n<p>He directed South Dakota Searchlight to his lawyer, Ryan Kolbeck, who said in a text that his client \u201cis cooperating with the investigation but has no further comment at this time.\u201d<\/p>\n<p>Pischke is the second state lawmaker charged with a felony this month. The first, Newell Republican Rep. Travis Ismay, was charged with felony damage to a roadway. Ismay\u2019s initial appearance is scheduled for July 10 at the Butte County Courthouse. Ismay won his primary contest on June 2 and is running unopposed in November.<\/p>\n<p>The charges filed against Pischke on Tuesday are linked to 16 fraudulent nominating forms for precinct committeeman and precinct committeewoman, according to a Minnehaha County Sheriff\u2019s office report in Pischke\u2019s criminal case file.<\/p>\n<p>People who hold those positions have a vote at county party meetings and are entitled to be delegates at the state GOP convention, the 2026 version of which begins on Thursday in Rapid City.<\/p>\n<p>As convention delegates, precinct committee members get to vote on the party\u2019s general election nominees for attorney general, secretary of state and other constitutional offices. They also get a vote in decisions made by their county\u2019s party.<\/p>\n<p>Minnehaha County Auditor Leah Anderson told South Dakota Searchlight that none of the candidates tied to Pischke\u2019s case appeared on the June 2 primary ballot.<\/p>\n<h4>Phony nomination forms catch auditor\u2019s eye<\/h4>\n<p>The questionable nomination forms arrived on March 30, one day before the deadline to appear on the June 2 primary ballot.<\/p>\n<p>While cross-checking the addresses listed on the forms, the court records say, one of Anderson\u2019s employees saw that the address of one purported candidate didn\u2019t match the address listed in their voter registration file. That spurred additional scrutiny for all 16 forms, the court records say, which Anderson noted had conspicuously similar handwriting.<\/p>\n<p>Her employees reached out to each person listed as a potential candidate to ask if they had signed the form, and most of them \u201cdid not know what the form was for,\u201d the records say.<\/p>\n<blockquote><p>Anti-tech push influences secretary of state race as conventions make state officer nominations<\/p><\/blockquote>\n<p><iframe loading=\"lazy\" frameborder=\"0\" height=\"282\" src=\"https:\/\/southdakotasearchlight.com\/2026\/06\/13\/anti-tech-push-influences-secretary-of-state-race-as-conventions-make-state-officer-nominations\/embed\/#?secret=XOnvKPPOdC#?secret=ZtnHaeGdLt\" title=\"\u201cAnti-tech push influences secretary of state race as conventions make state officer nominations\u201d \u2014 South Dakota Searchlight\" width=\"500\"><\/iframe><\/p>\n<p>Anderson also compared signatures from 15 of the 16 purported candidates to other documents bearing their signatures, and \u201cnone of the signatures matched the suspected fraudulent forms.\u201d<\/p>\n<p>A detective later spoke with each person for whom a form had been filed. Twelve said they had no idea their name had appeared on such a form. One said Pischke had asked them to run, but that they\u2019d declined to do so.<\/p>\n<p>Three others told the detective that they had wanted to run for the positions, and that Pischke had urged them to do so.<\/p>\n<p>When approached by a detective, the court documents say, Pischke denied signing the forms. He said he wouldn\u2019t expect his DNA or fingerprints to appear on them, the court documents say, and he consented to the collection of a DNA sample.<\/p>\n<p>Shortly thereafter, detectives obtained video footage of a vehicle dropping something off at the Dell Rapids Post office. The video only showed the driver\u2019s hand and wasn\u2019t clear enough to show what was placed in the box, the court documents say, but it was clear enough to show three of the numbers on the vehicle\u2019s license plate and the vehicle\u2019s make, model and approximate year: a 2000-2005 Chevy Impala.<\/p>\n<p>There\u2019s only one Chevy Impala in South Dakota of that vintage with a license plate number bearing the three characters seen in the video, and it\u2019s registered to Pischke.<\/p>\n<p>The South Dakota Forensic Lab, meanwhile, analyzed the envelopes and found DNA from three people. The \u201cmajor contributor\u201d of DNA was \u201cconsistent\u201d with Pischke.<\/p>\n<h4>No impact on convention<\/h4>\n<p>Pischke won\u2019t be at the state convention, according to Jim Eschenbaum, head of the state Republican Party.<\/p>\n<p>Read more <a href=\"https:\/\/propertyrelocationusa.com\/?p=2794\">Ex-Trump aide\u2019s words turned against him in fiery debate: \u2018Mike and I will have it out\u2019<\/a><\/p>\n<p>Pischke sent Eschenbaum a text on Monday to say he couldn\u2019t make it, without disclosing details about why.<\/p>\n<blockquote><p>Legislative primaries attract millions in spending as Republican factions fight for control<\/p><\/blockquote>\n<p><iframe loading=\"lazy\" frameborder=\"0\" height=\"282\" src=\"https:\/\/southdakotasearchlight.com\/2026\/05\/27\/legislative-primaries-attract-millions-in-spending-as-republican-factions-fight-for-control\/embed\/#?secret=IDLZEj0Do4#?secret=ZPPKaVk5pC\" title=\"\u201cLegislative primaries attract millions in spending as Republican factions fight for control\u201d \u2014 South Dakota Searchlight\" width=\"500\"><\/iframe><\/p>\n<p>Eschenbaum told Searchlight on Tuesday that he\u2019d heard rumors about possible fraud charges for Pischke, and that it was a \u201cbummer\u201d to learn that charges were filed.<\/p>\n<p>The convention, Eschenbaum said, will proceed as planned, just without Pischke.<\/p>\n<p>Korry Petterson, chairman of the Minnehaha County Republican Party, said he\u2019s been aware of the investigation for months and had also heard \u201crumors\u201d that Pischke was involved.<\/p>\n<p>Petterson had clashed with Pischke over the county party\u2019s direction, the chairman said, but \u201cstill, I don\u2019t even want to fathom that this is what happened.\u201d<\/p>\n<p>Unless Pischke is convicted, Petterson said, there\u2019s little the county party could do to discipline him.<\/p>\n<h4>Attempt to influence balance of power<\/h4>\n<p>Petterson told South Dakota Searchlight a few weeks ago that whoever was behind the attempt to influence the county party\u2019s voting membership was likely trying to hamstring his ability to conduct party business.<\/p>\n<p>Minnehaha County is South Dakota\u2019s most populous, and its county GOP\u2019s votes for party nominees at the state convention are weighted to reflect that population.<\/p>\n<p>Eschenbaum said the incident with Pischke is part of \u201cthe Minnehaha County drama that never ends\u201d in the Sioux Falls area over \u201cwho\u2019s in control.\u201d<\/p>\n<p>\u201cIt\u2019s who\u2019s in control of that county party,\u201d Eschenbaum said. \u201cThat\u2019s what this was about.\u201d<\/p>\n<p>There are three factions in the Minnehaha County GOP, Petterson said. The chairman described himself as part of a faction that aims to find middle ground between the party\u2019s more traditional wing and its populists \u2013 the category into which Petterson said Pischke falls.<\/p>\n<p>Who\u2019s in control at any given time is in part a function of precinct committee members, who can be elected during primaries or be nominated and voted on at meetings of the county party.<\/p>\n<p>The number of active precinct committee members fluctuates in any county, and not every position is filled. There are 145 now in Minnehaha County, and Pischke is one of them.<\/p>\n<p>To hold a meeting with a voting quorum, Petterson needs 20% of voting members present.
