President Donald Trump undermined Rep. Jim Jordan (R-OH)’s criminal most recent attack on Jack Smith with an early morning social media post, CNN legal analyst Elie Honig argued Thursday. <\/p>\n

The attack in question is the House Judiciary Committee chairman’s letter to the DOJ requesting a criminal investigation of the former special counsel, alleging that Smith made false statements last year during a closed-door congressional deposition.<\/p>\n

Trump weighed in on the matter Thursday morning \u2013 posting a link on Truth Social to a right-wing website reporting the criminal referral and adding, “Justice at last?” <\/p>\n

Honig said that could also undermine the case against Smith.<\/p>\n

“Well, if there comes a day<\/span> where Jack Smith does get<\/span> indicted, he surely will make a<\/span> motion to dismiss based on<\/span> vindictive prosecution,” Honig said. <\/span><\/p>\n

“He will<\/span> argue, ‘This prosecution is the<\/span> result of a long-standing anger<\/span> or beef that the president has<\/span> with me, I was therefore singled<\/span> out for prosecution because of<\/span> political reasons, because there<\/span> is a vendetta going on here,’ and<\/span> if he makes that argument, which<\/span> he surely will, if he gets<\/span> prosecuted, this will be an<\/span> exhibit to make that argument.”<\/span><\/span><\/p>\n

The evidence, no matter what Trump posts about the allegations, just isn’t strong enough to support a criminal prosecution, Honig argued.<\/span><\/p>\n

“In<\/span> order to make a perjury case,<\/span> you have to show a specific,<\/span> clear question and a specific,<\/span> clear, intentional, false<\/span> answer,” he said.<\/span><\/p>\n

“I<\/span>f there<\/span> was a critique of Jack Smith<\/span> that he wasn’t fully<\/span> forthcoming, that’s valid,” Honig added. “But<\/span> that’s different from saying he<\/span> committed a criminal act of<\/span> felony perjury.”<\/span><\/p>\n
