A directive that a U.S. Secret Service agent acknowledged \u201cin writing\u201d was \u201clegally questionable\u201d was followed through on regardless, former Trump administration official Miles Taylor flagged Monday in an analysis<\/u> published on his Substack.<\/p>\n

That directive came down from an individual identified in as \u201cthe # 3 guy at DOJ,\u201d who at the time in question would have been then-Acting Associate Attorney General Chad Mizelle<\/u> \u2013 his position officially described by the Justice Department (DOJ) as the \u201cthird-ranking official<\/u>\u201d at the agency. Authorized in May of 2025, the directive involved tracking former FBI Director James Comey\u2019s phone.<\/p>\n

On May 15, 2025, Comey posted a photo of seashells on social media, a post that Trump\u2019s allies have interpreted<\/u> as a threat on the president\u2019s life. The post immediately sparked a probe among top Trump administration law enforcement officials.<\/p>\n

\u201cThe Secret Service\u2019s own supervisor put his objection in writing. Pinging the phone \u2018could be done,\u2019 he warned, \u2018but it would be a bad idea,\u2019\u201d Taylor wrote, citing new court records recently made public. <\/p>\n

\u201cWarrantless emergency tracking requires an imminent threat to life, and \u2018we did not believe that anyone\u2019s life was in immediate danger.\u2019 It was, in his words, \u2018legally questionable.\u2019 His boss agreed, according to the emails, \u2018but said we might do it anyway.\u2019 And they did.\u201d<\/p>\n

Despite the apparent concern, a Secret Service agent from Verizon \u201cthe next day,\u201d Taylor wrote, to track Comey\u2019s phone, and indicated that it was \u201ctrue and correct\u201d that the request involved \u201can emergency involving danger of death or serious physical injury.\u201d<\/p>\n

\u201cThere was no emergency, and everyone involved seemingly knew it,\u201d Taylor wrote. \u201cAgents then tracked Comey electronically and tailed him as he and his wife drove home from North Carolina to Virginia, including as they stopped to visit the grave<\/u> of their deceased son.\u201d<\/p>\n

Comey would ultimately be indicted on two felony counts related to his Instagram post, indictments that his legal team has since asked be dismissed<\/u> out of hand.<\/p>\n

Taylor expressed great concern, however, over the precedent that had been set with the Trump administration\u2019s actions.<\/p>\n

\u201cThe precedent is not really about Comey. It\u2019s about each of our constitutional rights, the phones in our pockets, and about what we are allowed to say before the government reaches for those devices,\u201d Taylor wrote.<\/p>\n

\u201cThe new details from last week show that the president has given himself the ability to name an enemy, point to that enemy\u2019s free speech, and then wiretap him over it without the approval of any judge. That\u2019s at least three constitutional violations.\u201d<\/p>\n
