U.S. Attorney Jeanine Pirro’s newly reported “very unusual” move suggests a sinister development in play, MS NOW legal analyst Lisa Rubin said Wednesday.<\/p>\n

Rubin took to the airwaves to discuss the convening of a special grand jury in Washington, D.C., with Pirro’s top lieutenant Steven Vandervelden tasked with leading the helm. <\/p>\n

“W<\/span>hy would Jeanine<\/span> Pirro want a special grand jury?” Rubin said.<\/span> “It might be in a circumstance<\/span> where she can statutorily have<\/span> that grand jury issue, a report<\/span> that might dirty somebody up.<\/span>“<\/span><\/p>\n

Rubin based this claim \u2014 that Pirro might be setting out to tarnish someone’s reputation \u2014 on the <\/span> significance of a single word: special. <\/p>\n

“A<\/span> special grand<\/span> jury can issue a report by<\/span> statute and by federal law,<\/span> specifically, but it can only<\/span> submit to the court a report in<\/span> special circumstances,” she said. <\/span><\/p>\n

“T<\/span>hat’s with<\/span> respect to…<\/span>non-criminal misconduct,<\/span> malfeasance or misfeasance in<\/span> office involving organized<\/span> criminal activity by someone <\/span>who is currently a public<\/span> officer or employee.”<\/span><\/p>\n

Said Rubin, “<\/span>Perhaps<\/span> the reason for impaneling a<\/span> special grand jury here has<\/span> something to do with the<\/span> permitted subject matter of the<\/span> report.”<\/span><\/p>\n

Host Alicia Menendez suggested that Pirro might be targeting Jerome Powell, the former Federal Reserve chair who still serves on its board of governors.<\/p>\n

Rubin replied the pool of possible targets was broad \u2014 but whoever it was likely could not be hauled into court under usual methods. <\/p>\n

“T<\/span>hinking about why would you<\/span> want a special grand jury, it<\/span> may be because you already<\/span> understand that you’re not<\/span> going to be able to meet the<\/span> threshold for indicting someone,” she said, “<\/span>but you want the public to know<\/span> that that person has done<\/span> something that we would<\/span> consider, in a broader sense,<\/span> wrong.”<\/span><\/p>\n

Rubin condemned such political attacks as improper \u2014 but not unlikely considering the current state of the Justice department. <\/span><\/p>\n

“T<\/span>hat is not the proper purpose<\/span> of a special grand jury, but I<\/span> would also submit to you, based<\/span> on evidence of how this<\/span> Department of Justice has<\/span> behaved,” she said, “It’s not beyond what<\/span> they have done in prior<\/span> situations or how they think<\/span> necessarily.”<\/span><\/p>\n

Pirro’s selection of the lightly experienced Vandervelden was another clue how this special grand jury would operate, argued Rubin.<\/span><\/p>\n

“He is not is an experienced former federal prosecutor or federal prosecutor at all,” she said. “He’s not somebody who historically has that DOJ experience you would want in a special grand jury context.”<\/p>\n
